The Aurangabad bench of the Bombay High Court has pulled up the principal secretary of the medical education department, saying there is no need to explain how there is fakeness in the process of recruitment of drug inspectors. The court also directed the secretary to appear before it during the hearing on Wednesday.

In 2010, the Maharashtra Public Service Commission (MPSC) had conducted the recruitment process for the post of drug inspector of the government. The candidates had moved the court alleging that there was a scam in the recruitment. Accordingly, during a hearing in the Aurangabad bench of the Bombay High Court in February 2022, the recommendations of the disqualified candidates should be quashed. The court had directed that the petitioners be appointed to their vacancies within four months after considering their eligibility, the category applied and the reservation. However, amol lekurwale, Pankaj Yeole, Santoshsingh Rajput and Parag Pathre filed a contempt petition as there was a huge delay in scrapping the recommendations by the government.

अवमान याचिकेवर सुनावणीतून सवलत मिळवण्यासाठी सादर केलेले प्रपत्रच बनावट आहे. विभागाचा सर्वाेच्च अधिकारीच बनावट कागदपत्रे सादर करतो, तर विभागात काय आलबेल असेल. औषध निरीक्षक भरतीप्रक्रियेत बनावटपणा कसा आहे हे सांगायची गरज नाही, अशा शब्दांत मुंबई उच्च न्यायालयाच्या औरंगाबाद खंडपीठाने वैद्यकीय शिक्षण विभागाच्या प्रधान सचिवांवर ताशेरे ओढले. बुधवारी (दि.२४) सुनावणीवेळी हजर राहण्याचे आदेशदेखील न्यायालयाने सचिवांना दिले आहेत.

• शासनाच्या औषध निरीक्षकपदाच्या भरतीसाठी महाराष्ट्र लोकसेवा आयोगाने २०१० मध्ये भरती प्रक्रिया राबविली होती. भरतीत घोटाळा झाल्याचा आरोप करत भरतीत उतरलेल्या उमेदवारांनी या विरोधात न्यायालयात धाव घेतली होती. त्यानुसार मुंबई उच्च न्यायालयाच्या औरंगाबाद खंडपीठात फेब्रुवारी २०२२ मध्ये झालेल्या सुनावणीवेळी अपात्र उमेदवारांच्या शिफारशी रद्द कराव्या. त्यांच्या रिक्त जागी चार महिन्यांत याचिकाकर्त्यांची पात्रतेनुसार, अर्ज केलेल्या श्रेणी व आरक्षणानुसार विचार करून नियुक्ती करण्याचे आदेश न्यायालयाने दिले होते. पण, शासनाकडून शिफारशी रद्द करण्यास प्रचंड विलंब होत असल्याने अमोल लेकुरवाळे, पंकज येवले, संतोषसिंग राजपूत व पराग पाथरे यांनी अवमान याचिका दाखल केली.
• औरंगाबाद खंडपीठात अवमान याचिकेवर ११ तारखेला झालेल्या सुनावणीवेळी प्रधान सचिवांना पुढील तारखेला म्हणजे १८ एप्रिलला समक्ष हजर राहण्याचे आदेश दिले होते. मात्र, या सुनावणीवेळी प्रधान सचिवांनी वकिलांमार्फत अर्ज दाखल करत हजर राहण्यापासून सूट देण्याची विनंती केली. त्यावर याचिकाकर्त्यांतर्फे ॲड. व्ही. डी. साळुंके यांनी अर्जासोबत बनावट प्रपत्र जोडल्याचे न्यायालयाच्या निदर्शनास आणून दिले. न्यायालयाने या प्रकाराची गंभीर दखल घेत प्रधान सचिवांना फटकारले. बनावट प्रपत्र सादर करून न्यायालयाचा अवमान केल्याचे सांगत यापूर्वीच्या अवमान याचिका व बनावट प्रपत्र सादर प्रकरणीच्या अवमानासाठी येत्या बुधवारी होणाऱ्या सुनावणीस हजर राहण्याचे आदेश औरंगाबाद खंडपीठाने प्रधान सचिवांना दिले आहेत.
• पदापासून वंचित –  भरती प्रक्रियेत एकूण २१ उमेदवार औषध निरीक्षकपदास अपात्र असल्याचे आयोगाने घोषित केले होते. पण, त्यांच्या शिफारशी रद्द करण्यास २०२४ उजाडावे लागले. त्यातही १३ उमेदवारांना अपात्रतेतून सूट देताना उर्वरित आठ उमेदवारांची शिफारस रद्द करण्यात आली. लोकसेवा आयोगाच्या या भूमिकेमुळे याचिकाकर्ते औषध निरीक्षक या पदाच्या लाभापासून वंचित राहात असल्याची बाब १२ एप्रिलच्या सुनावणीतून पुढे आली होती.
