Central Govt Jobs new updates – The Supreme Court on Thursday observed that the same rules will continue till the process of changing rules related to recruitment of government employees is allowed. Noting that the recruitment process starts after the advertisement for inviting applications and ends after filling up the vacant posts, the court said that the rules of recruitment of jobs cannot be changed in the middle.
It can be amended under Section 14 of the Constitution only if the existing rules and rules or criteria under advertisements are allowed to be changed. No one can be arbitrary about it. It is mandatory for the organisations implementing the recruitment process to comply with existing rules that have statutory powers. Even if a place is made in the selection list, the candidate does not get any right to appoint. The bench observed that the state government or its institutions can take a decision on non-filling up of vacant posts if there is a good reason.

सरकारी नोकर भरतीसंदर्भातील नियम बदलांच्या प्रक्रियेला परवानगी मिळत नाही तोपर्यंत आहे तेच नियम कायम राहतील असे निरीक्षण गुरुवारी सर्वोच्च न्यायालयाने नोंदवले. अर्ज मागविण्यासाठी जाहिरात दिल्यानंतर भरती प्रक्रिया सुरू होते व रिक्त पदे भरल्यानंतर ती संपत असल्याचे नमूद करत नोकर भरतीचे नियम मध्येच बदलता येणार नसल्याचे न्यायालयाने स्पष्ट केले.
भरती प्रक्रियाच्या सुरुवातीच्या अधिसूचित केलेल्या यादीतील पात्रता निकष किंवा नियम परवानगी घेतल्यानंतरच किंवा एखादी जाहिरात सध्याच्या नियमाविरोधात असल्याशिवाय मध्येच बदलता येणार नसल्याचे सरन्यायाधीश डी. वाय. चंद्रचूड यांच्या अध्यक्षतेखालील पाच न्यायाधीशांच्या खंडपीठाने नमूद केले.
सध्याचे नियम व जाहिराती अंतर्गतचे नियम किंवा निकष बदलण्याची परवानगी असेल तरच घटनेच्या कमल १४ अंतर्गत त्यात बदल करता येईल. यात कोणालाही मनमानी करता येणार नाही. वैधानिक शक्ती असणाऱ्या विद्यमान नियमांचे पालन करणे भरती प्रक्रिया राबविणाऱ्या संस्थांना बंधनकारक आहे. निवड यादीत स्थान मिळाले तरी उमेदवाराला नियुक्तीचा कोणताही अधिकार मिळत नाही. राज्य सरकार किंवा त्यांच्या संस्था ठोस कारण असेल तर रिक्त पदे न भरण्यासंदर्भात निर्णय घेऊ शकतात, असे निरीक्षण खंडपीठाने नोंदवले.
